TERMS AND CONDITIONS

1. GENERAL TERMS OF USE AND ACCEPTANCE

This legal notice regulates access to and use of the contents of VIP LOUNGE (hereinafter collectively referred to as the “Website”), owned and administered by Grupo Aeroportuario del Pacífico, S.A.B. de C.V., Aerocomercializadora del Pacífico, S.A. de C.V., and its subsidiary and affiliated companies (hereinafter “GAP”). Its use is subject to the terms and conditions specified below.

By accessing the Website, you may access the tools, services, purchases, and functional features located therein (hereinafter the “Service”). The term “You” or “User” refers to the member with an account on the Website.

By using this Website, you accept these terms and conditions and agree to abide by them. If you do not agree with these terms or our Privacy Notice, please refrain from using this Website or the products and/or services offered herein. Otherwise, your acceptance will be assumed.

The use of this Website implies the User’s full acceptance of the terms and conditions published by GAP at the time the User accesses it. Therefore, the User must carefully read these Terms each time they access this Website, as they may have been modified.

2. WEBSITE ACCESS CONDITIONS

The Service and content provided on the Website are the property of GAP. Therefore, the User, by accessing the services and functional features contained on the Website, agrees to the following:

As a User, you agree to use the information, content, and services accessed on the Website in compliance with the law, good customs, and these General Terms of Use, as well as to respect other users.

The User agrees not to use any material or information contained on the Website for unlawful purposes or those expressly prohibited in these General Terms of Use or any applicable specific conditions, which may be contrary to the rights and interests of GAP, its employees, and/or third parties. The User shall be liable to GAP for any breach or non-compliance with these obligations and/or for any damage, disablement, overloading, deterioration, or interference with the normal use of the Website’s contents, information systems, documents, files, or any other content stored on any computer system (hacking) of GAP, its employees, or any other Website User.

The User is solely responsible for the truthfulness and updating of the information and data provided to GAP, guaranteeing at all times their accuracy and correctness. GAP assumes no duty or commitment to verify the information received from its clients.

The User who breaches the obligations outlined herein shall be liable for all damages caused to GAP.

3. VIP LOUNGE USAge CONDITIONS

All charges for any purchase will be in Mexican pesos.

VIP Lounges, located beyond inspection points, are exclusively for passengers with departing flights from the airport where they are located.

During registration, it is mandatory to present a valid official ID and a boarding pass for departure with the current date.

Memberships, if purchased, are non-transferable and may only be used by the holder at the time of registration.

The User must present their VIP Passport membership at the reception of the VIP Lounges, which must be valid at the time of requesting access.

The User must present their official ID, which must match the Passport membership.

If the User does not have a Passport membership, they may enter by purchasing a One Day Pass at the reception of the VIP Lounges. This pass is personal, and if traveling with a companion, a Day Pass must be purchased for each companion.

The operating hours of the VIP Lounges depend on the flight schedule of each airport and terminal and may vary without prior notice.

There is no flight announcement service inside the lounges, so the User accepts that VIP Lounge shall not be responsible for any missed flights, whether for the holder or their guests.

Telephone services are free and limited to local calls.

Admission to the VIP Lounges is subject to Users complying with the behavior and dress code established by the VIP Lounges. Anyone who does not adhere to the VIP Lounge rules may be asked to leave.

VIP Lounge Usage Conditions

VIP Lounges reserve the right of admission and may deny access or request the removal of Users who cause discomfort due to misconduct.

It is mandatory to present a boarding pass for departure to enter any VIP Lounge.

Complimentary products are for exclusive use and consumption within the VIP Lounges.

All areas of the VIP Lounges are smoke-free, except for VIP Lounges in any airport that have a designated smoking area.

VIP Lounge or its staff are not responsible for lost or forgotten items within the facilities of any VIP Lounge.

Service animals or animals authorized to travel in the cabin are allowed in the VIP Lounges, provided they remain in their carrier and with their owner at all times. Only dogs and cats are considered service animals or allowed to travel in the cabin.

VIP Lounges reserve the right to change, modify, or partially or completely remove any or all of the Terms and Conditions of Access to the VIP Lounges, as well as to close one or all of the VIP Lounge Network, without prior notice.

Access to any VIP Lounge is subject to availability.

Before using the Meet & Greet accompaniment services, it is essential to verify availability and make a prior reservation by emailing: [email protected][email protected], and/or [email protected].

After reservation, the User will receive confirmation of the service to be provided on the requested date and time.

4. DISCLAIMER OF WARRANTIES AND LIABILITY

GAP will make every effort to keep the Website operational; however, certain technical difficulties or maintenance may occasionally result in temporary interruptions. GAP reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, the functions and features of the service and the Website, with or without prior notice, without liability for any interruption, modification, or discontinuation of the Service or any of its functions or features. GAP does not guarantee the availability or continuity of the Service or the Website and excludes, to the fullest extent permitted by applicable law, any liability for damages that may arise there from. If the User detects any malfunction on the Website, they may report it to GAP at: [email protected].

The User is responsible for taking the necessary precautions to verify the absence of viruses or other harmful programs. GAP is not responsible for the existence of harmful elements, such as viruses, that may cause damage or malfunction to the systems, software, hardware, programs, documents, and electronic files maintained by the User. Likewise, GAP is not responsible for any damage that the User may cause to third parties as a result of such elements. The User uses this Website voluntarily and at their own risk. GAP shall not be liable, contractually or extracontractually, for direct or indirect, unforeseen, emergent, or punitive damage resulting from access to or use of this Website.

GAP makes every effort to ensure that its Website contains accurate and up-to-date information; however, it does not guarantee or declare that this information is free of errors or omissions. Such errors or other technical issues may result in inaccurate information. Accordingly, GAP reserves the right to correct any inaccuracies, omissions, and/or errors on its Website or others that the User may access through it. Additionally, the User may notify GAP of any errors, omissions, and/or inaccuracies in the information provided on its Website through the feedback section located on the Website itself.

5. LINKS TO OTHER WEBSITES

This Website may contain links or hyperlinks to other sites and web pages managed by third parties over which GAP exercises no control. GAP does not manage or endorse these sites and is not responsible for the content of the links contained therein. GAP is not responsible for the content and information included in other links, nor for the terms of use and privacy policies published on them. It shall not be construed that these links are an extension of our Website or that we share the opinions expressed therein or have any interest or collaboration in the services provided or marketed on them.

6. INTELLECTUAL PROPERTY RIGHTS

This Website is governed by Mexican laws and is protected by national and international intellectual property legislation. All intellectual property rights over this Website are legally reserved. Access or use of the Website shall not, under any circumstances, constitute the granting, unless expressly stated otherwise, of any license to use or right over any asset owned by GAP. All content displayed on this Website is subject to industrial property rights. Likewise, the texts, graphics, images, icons, technology, software, as well as their graphic design and source code, constitute a work subject to intellectual property rights.

The User is strictly prohibited from: reproducing, copying, distributing, transforming, making available to the public, deleting, and/or manipulating the security systems installed on the Website, and any other activity that may be performed with the content, information, and trademarks appearing on this Website, as well as with its source code, images, design, and presentation of the materials included therein, regardless of their purpose and the means used to do so.

Accordingly, the User agrees that the following is strictly prohibited:

  • Using robots, spiders, data extraction tools, deep links, automated data collection tools, or any similar extraction tool, program, algorithm, or methodology to access, acquire, copy, or monitor the Website, the information contained therein, and/or the Service;
  • Attempting to decipher, decompile, disassemble, or reverse engineer the software or in any way reconstruct any part of GAP’s Website or the Service.

7. APPLICABLE JURISDICTION AND COMPETENCE

The parties agree that, for all matters not provided for in these Terms and Conditions, the applicable laws of Jalisco, Mexico, shall govern. Likewise, the parties agree that, in the event that the interpretation and/or compliance with these Terms and Conditions must be submitted to judicial decision, they shall be subject to the jurisdiction of the competent courts of Guadalajara, Jalisco, Mexico, expressly waiving any other jurisdiction that may correspond to them by reason of their current or future domicile or any other cause.

8. ACCEPTANCE OF THE WEBSITE ACCESS AND USE CONDITIONS

Access and use of this Website, as well as its services and the information included therein, imply acceptance of the terms specified in these General Terms of Use. If you do not agree with them, please refrain from accessing or using this Website.

10. CANCELLATION AND REFUND POLICY FOR VIP LOUNGE PRODUCTS AND SERVICES

General Terms for Usage Conditions of VIP Lounge and VIP Passport Products and Services

1. Sale of One Day Pass

1.1 The cost of this service is per person and applies to Departure, Domestic, and International VIP Lounges, as well as Arrivals VIP Lounges.
1.2 The pass may only be used in the VIP Lounge selected at the time of purchase.
1.3 Changes to the selected VIP Lounge cannot be made once the purchase is completed.
1.4 The One Day Pass has a maximum stay limit of 8 hours.
1.5 Children under 7 years old do not pay for VIP Lounge access.
1.6 Costs may vary depending on the type of service provided and the airport.
1.7 The service is valid for 2 months from the date of purchase and is non-refundable under any circumstances.
1.8 Minors under 18 years old must be accompanied by an adult.
1.9 Access to any VIP Lounge is subject to availability.
1.10 The operating hours of the VIP Lounges depend on the flight schedule of each airport and terminal and may vary without prior notice.
1.11 To access any VIP Lounge with a One Day Pass, the User must present a boarding pass for departure with the flight date matching the entry date, as well as a valid official ID.
1.12 Customers purchasing this service must accept and comply with the VIP Lounge rules.
1.13 Payment for this service can only be made via credit or debit card.
1.14 The complimentary alcoholic beverage service (where permitted by law) is at the discretion of each VIP Lounge and may be limited to a certain number of drinks.

2. Sale of VIP Passport Memberships

2.1 The cost of this service is per person, and the membership is granted to the holder.
2.2 VIP Passport members may access any VIP Lounge in the GAP network.
2.3 VIP Passport members may also access any of the 4 VIP Lounges operated by Mera at Cancún International Airport through the following means: Passport Memberships, additional visits at a preferential rate, or the purchase of a Day Pass.
2.4 Memberships are non-transferable and may only be used by the holder at the time of registration. For Classic and Pro memberships, the holder may use their available guest accesses, provided the holder is also present.
2.5 Holders of Master memberships are entitled to bring one complimentary guest per visit. Additional guests must purchase additional accesses at a preferential rate of $525.00 MXN (taxes included).
2.6 The User must present their official ID, which must match the name registered in the Application, as well as a valid boarding pass for the day of entry to the VIP Lounge.
2.7 Children under 7 years old do not pay for VIP Lounge access.
2.8 Access to any VIP Lounge is subject to availability.
2.9 The operating hours of the VIP Lounges depend on the flight schedule of each airport and terminal and may vary without prior notice.
2.10 The membership is valid for 12 months from the date of purchase and is non-refundable under any circumstances.
2.11 Customers purchasing this service must accept and comply with the VIP Lounge rules.
2.12 Payment for this service can only be made via credit or debit card.

3. Sale of Meet & Greet Services

3.1 The cost of the service is per person, applicable to Meet & Greet services.
3.2 Meet & Greet service for children under 2 years old is complimentary.
3.3 Children under 7 years old do not pay for access to the Arrivals VIP Lounge in Puerto Vallarta.
3.4 In case of any itinerary changes, notification must be given as soon as possible, and any modifications will be subject to availability to provide the service.
3.5 The maximum number of passengers for Meet & Greet service per flight is 7.
3.6 Migration and Customs areas are independent airport areas with their own rules, which must be respected by passengers and lounge staff.
3.7 During Meet & Greet services, lounge staff will accompany passengers but will not assist in filling out official documents or prevent interviews by Migration and Customs as per protocol.
3.8 Meet & Greet is an accompaniment service and does not include fast track or preferential access.
3.9 Meet & Greet services end once the passenger is dropped off at the Transportation area or inside the Arrivals VIP Lounge.
3.10 For changes or modifications to a scheduled Meet & Greet service, notification must be given at least 72 hours in advance (subject to availability). Otherwise, the service will be canceled.
3.11 Customers purchasing this service must accept and comply with the VIP Lounge rules.

 

Usage Conditions

By using the products and services, the User accepts these usage conditions. VIP Lounge reserves the right to modify these conditions at any time. The User agrees that VIP Lounge may communicate these conditions by publishing them on the Aeropuertos GAP and VIP Lounge website, as well as on the Aeropuertos GAP mobile app, and that the use of the products and services by the User constitutes acceptance of the current conditions. Users are advised to review these conditions before using the products and services.

 

Cancellation and Refund Policy for Products and Services

1. Cancellation and Refund of One Day Pass

1.1 Users who pay for lounge access or a Day Pass with a credit, debit, or AMEX card directly at the VIP Lounge reception but decline to enter at the counter may request a cancellation of the sale.
1.2 Users who enter the lounge, use the facilities, and consume food and beverages but leave without any complaint or comment are not eligible for a refund or cancellation.
1.3 Users who enter the lounge and during their stay experience operational issues such as power outages, lack of water, or any other incident attributable to the lounge and/or airport that severely affects the level and quality of service may request a refund. In such cases, complimentary access for a future visit to any GAP lounge will be offered first. If the User declines the courtesy, the sale will be canceled.
1.4 Users who are notified at the time of registration that the lounge has a technical or operational incident affecting the level of service and comfort provided, such as lack of water in restrooms, air conditioning failures, etc., and choose to enter, use the facilities, and consume food and beverages but later request a refund or complaint, are not eligible.
1.5 Users who are notified at the time of registration that the lounge has a technical or operational incident affecting the level of service and comfort provided, such as lack of water in restrooms, air conditioning failures, etc., and choose to enter, use the facilities, and request a refund upon leaving, must submit a written statement describing the reasons for the complaint and refund. This document will be reviewed by corporate and airport authorities to determine if a refund is warranted, as outlined in point 6.1.3.
1.6 Under no circumstances will cancellations or refunds be issued for a One Day Pass purchased online, whether through our E-commerce portal or the Aeropuertos GAP app.

2. Cancellation and Refund of VIP Passport Memberships

2.1 Under no circumstances will cancellations or refunds be issued for a VIP Passport membership purchased through the Aeropuertos GAP app or directly at the counter. Once purchased, the membership is NON-refundable, NON-transferable, and NON-endorsable.
2.2 VIP Lounge reserves the right to revoke the VIP Passport membership at any time, at its sole discretion and without prior notice. A proportional refund of the annual fee or membership payment will be issued if the revocation is not due to fraudulent or improper use by the User. VIP Lounge reserves the right to immediately cancel, without any refund, the membership of any User who violates the usage conditions.
2.3 VIP Lounge reserves the right to suspend or cancel the membership subscription at its sole discretion without refund if the provided information is false, incorrect, and/or incomplete.

3. Cancellation and Refund of Meet & Greet Services

3.1 No refunds will be issued for cancellations or no-shows.
3.2 For same-day cancellations not attributable to the airline or airport (e.g., flight cancellation or airport closure), no refund will be issued, and the service cannot be used at a later date.
3.3 For cancellations made less than 72 hours before the scheduled service and not attributable to the airline or airport (e.g., flight cancellation or airport closure), no refund will be issued, and the service cannot be used at a later date. If the cancellation is attributable to the airport or airline, no refund will be issued, but the service may be used within 2 months of the original scheduled date.
3.4 If the cancellation of the Meet & Greet service is due to reasons attributable to the client and is made with at least 72 hours’ notice, no refund will be issued, but the service may be used at a later date within 2 months of the original scheduled date (not the purchase date) and may be used at any airport where this service is available.
3.5 For changes or modifications to a scheduled Meet & Greet service, notification must be given at least 72 hours in advance, and availability will be checked. Otherwise, the service will be canceled without a refund.
